Bill 21: Changes to the Employment Standards Act coming October 29, 2014


On October 29, 2014, Bill 21, the Employment Standards Amendment Act (Leaves to Help Families), 2014 comes into force. As employers it is important that you familiarize yourself with these new leave requirements. For employees, if you need to access these important protections in such dire circumstances, it is important that you recognize your newly established entitlements.

The Bill:

The bill will amend the ESA, creating 3 new job-protected leaves of absence for eligible employees.

The Leaves:

Family Caregiver Leave

Eligible employees can receive up to 8 weeks of unpaid, job-protected leave. The leave allows employees to provide care or support for a family member with a serious medical condition.

Critically Ill Child Care Leave

Eligible employees can receive up to 37 weeks of unpaid, job-protected leave to provide care to a critically ill child. During this protected leave, the parent may be eligible for Employment Insurance Benefits (E.I.), but this is regulated through the federal government and the Federal Employment Insurance Act.

Crime-Related Child Death or Disappearance Leave

This leave allows for eligible employees to take unpaid, job-protected leave if their child is missing or has died as a result of a crime.
