Agreements of Purchase and Sale

Although it is February and the snow is falling, the wind is blowing and the temperature is often below zero, we understand that you are still out there looking at houses and dreaming about buying something new.

Agreements of Purchase and Sale

Although these transactions may take place in warmer weather, while you are negotiating your Agreements of Purchase and Sale it is important to remember the ways in which a lawyer can help you with that Agreement.
Although you may have a real estate agent to assist you with the negotiations and the drafting of an Agreement of Purchase and Sale, a lawyer can search the property with the Land Registry Office to confirm:
(1) the legal description of the Property;
(2) the names of the owners of the Property (to confirm the appropriate people are selling the Property);
(3) if there are any items registered on title that should be discussed in the negotiations; and
(4) if there are any items that may need to be rectified or investigated prior to the title search date;

Lawyer Review

A lawyer can also review the Agreement of Purchase and Sale and confirm that you are protected by inserting specific clauses into the Schedule "A" of the Agreement, or confirm that the clauses are worded in order to provide you with the utmost protection. A lawyer can also explain the wording and implications of the clauses in the Agreement of Purchase and Sale in order to confirm that you understand the contract you are signing and the implications of that contract.

If you do not have a real estate agent assisting you a lawyer can draft your Agreement of Purchase and Sale and assist you with the negotiations.
